Captain Driver Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Driver", "you", or "your") and Rapid Kanishka Services Pvt. Ltd. ("Company", "we", "us", or "our"), governing your use of the Captain mobile application ("App") to offer transportation services (cab or auto rickshaw) to passengers.

1. Eligibility

  • You must be at least 18 years of age and possess a valid commercial driving license issued by the applicable authority.
  • You must own or have legal authorization to operate a registered cab or auto rickshaw with proper permits.

2. Onboarding and Registration

  • You agree to provide accurate, complete, and updated information during onboarding.
  • Required documents include Driving License, vehicle registration certificate, insurance, pollution certificate, and valid permit.
  • The Company may conduct background checks and vehicle inspections.

3. Use of the App

  • The App provides a platform to connect you with passengers seeking transportation.
  • You must accept ride requests in good faith and complete trips as agreed.
  • You are prohibited from transferring your account or subletting access to the App.

4. Service Standards

  • You must maintain cleanliness and roadworthiness of your vehicle.
  • You must treat passengers with courtesy and avoid any form of discrimination or misconduct.
  • You shall comply with all applicable traffic laws and safety standards.

5. Fares and Payments

  • Fare calculations are done via the App based on distance, time, and dynamic pricing.
  • Payouts will be processed to your registered bank account as per the applicable payout schedule.

6. Cancellations

  • You may cancel a ride only for valid reasons (e.g., safety concerns or incorrect location).
  • Frequent or unjustified cancellations may lead to penalties or suspension.

7. Ratings and Feedback

  • Passengers may rate your service; consistent low ratings may lead to suspension or retraining.
  • You may also rate passengers, which helps maintain quality on the platform.

8. Taxes

  • You are responsible for all applicable taxes (e.g., GST).
  • The Company may deduct TDS (Tax Deducted at Source) as per applicable laws.

9. Suspension and Termination

The Company reserves the right to suspend or terminate your access for reasons including:

  • Violation of these Terms
  • Misconduct or passenger complaints
  • Inactivity
  • Fraud or abuse of the platform

10. Liability and Insurance

  • You are responsible for maintaining vehicle insurance and passenger liability coverage as required by applicable law.
  • The Company is not liable for any damages, loss, or injury arising during rides, except where required by law.

11. Modification of Terms

  • The Company reserves the right to update these Terms at any time.
  • Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws applicable in Didwana, Rajasthan, and disputes shall be subject to the exclusive jurisdiction of the courts in Didwana, Rajasthan.
